Terms of Service

These terms govern a school's use of Daybook. By creating an account, by starting a trial or a subscription, or by using Daybook, you agree to them, and the person doing so confirms they are authorised to act for the school.

1. The service

Daybook is an Elevate Grade product, operated by SchoolConex Inc. (“we”, “us”). A school uses it to keep its timetable and attendance, to record lessons and meetings, to have transcripts and notes made from the recordings, and to ask questions about what was said.

2. Accounts

  • You must give accurate details for your account and your school, and keep your password secure.
  • Each account belongs to one school. A school's administrators can add users to it and deactivate them.
  • You are responsible for activity under your account, and the school for its users' use of Daybook.

3. Plans

  • A school is on one plan: Starter, Pro or School. Each is priced for each teacher, each month, in Canadian dollars for a school in Canada and in US dollars for any other, as the pricing page shows. The School plan is for 10 teachers or more.
  • Every active user of a school counts as a teacher, administrators included.
  • Each plan gives every teacher an allowance for each calendar month, in the school's time zone: hours of recording, and AI actions. An AI action is a question, a recipe run, or a note's notes written again on request. The notes written after each recording are not counted.
  • Once a teacher has used a month's allowance, Daybook does not record or answer for them beyond it until the next month begins, or until the school moves to a plan that allows more. A change of plan holds at once, for the month under way as well.
  • Deleting a recording does not give back the time it used.

4. Trial and billing

  • A school that signs up starts with a free trial of 14 days. No card is needed to start it.
  • Before the trial ends, an administrator can add a card in Billing. With a card, the subscription carries on when the trial ends and the first month is charged then. Without one, the subscription is cancelled when the trial ends.
  • A subscription is billed monthly, in advance, in the currency it began in: the plan's price for each teacher, times the number of seats. Payments are made through Stripe, our payments provider, which keeps the card. Daybook never sees the card number.
  • The number of seats follows the number of active users in the school, and is never fewer than the plan is for. When an administrator adds or deactivates a user, the seats change with them, and Stripe charges or credits the rest of that month on the next invoice.
  • An administrator changes the plan or the seats in Billing, through Stripe's billing portal. A new plan's allowances hold from the moment Stripe confirms the change, for the month under way as well.
  • An administrator can cancel the subscription in the same place. It ends at the end of the period already paid, and until then the school uses Daybook as before.
  • While a school has no trial or paid subscription, because the trial ended without a card, a payment failed, or the subscription was cancelled, its users cannot make new recordings or ask AI questions. Everything already recorded can still be read and exported, and recording comes back once a subscription is active again.
  • A school whose use of Daybook is arranged with us directly is billed as that arrangement says, not through these steps.
  • We may change prices with at least thirty days' notice by email to the account owner. A change applies from your next renewal after the notice period.

5. Acceptable use

You agree not to misuse Daybook, including by attempting to access another school's data, uploading unlawful content, reverse-engineering the service, getting around its usage limits, or reselling access without authorisation.

Before you record other people, get their consent; the recorder reminds you. Whether a class or a meeting may be recorded is the school's decision, and the school is responsible for the notice and consent it needs, including a parent's where that is required.

6. Your content

Recordings, transcripts, notes, student records and everything else your school puts into Daybook remain yours. You grant us a limited licence to process that content solely to provide Daybook, including sending recordings to a transcription service and transcripts to an AI model, as the Privacy Policy describes.

7. Transcripts, notes and answers

Transcripts are made by a transcription service, and notes and answers are written by an AI model. They can be wrong. A person remains responsible for checking them before relying on them or sharing them.

Transcripts and notes never change attendance: only a teacher or an administrator marks a student. Daybook sends no email by itself: a teacher reads each one and presses Send.

8. Google

Connecting a Google account is optional, and Daybook works without it. A teacher who connects one can send email they have written from their own Gmail, and see their Google Calendar beside their timetable. The Privacy Policy says what Daybook does with the connection.

9. Availability and changes

We work to keep Daybook available but do not guarantee uninterrupted access. We may update features, and will give reasonable notice of material changes to these terms. If a change materially reduces the service you pay for, you may cancel before it takes effect.

10. Ending

You may stop using Daybook at any time. We may suspend or end access for a breach of these terms, or for non-payment after notice. When a school's use ends, its data is handled as the Privacy Policy describes.

11. Disclaimers and liability

Daybook is provided “as is”. To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing limits liability that cannot be limited by law.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. This reflects where Elevate Grade is established and does not limit Daybook to any particular country: schools elsewhere may use it, subject to their own local obligations.
